《中华人民共和国烟草专卖法》 第七条 烟叶是指生产烟草制品所需的烤烟和名晾晒烟，名晾晒烟的名录由国务院烟草专卖行政主管部门规定。未列入名晾晒烟名录的其他晾晒烟可以在集市贸易市场出售。根据《国务院名晾晒烟目录》和烟叶调制方法判断，旱烟是未列入名晾晒烟目录的其他晾晒烟，不属于烟草专卖品，可以在零售终端自由销售。
