开工作室和开公司的区别 |

开工作室和开公司最直接的区别就是企业的模式，工作室只能是个人或者合伙企业不具备法人资格，承担无限连带责任；公司具备法人资格，承担有限责任。具体如下：
1、财产责任的不同：
（1）工作室属于财产的无限责任；
（2）公司属于财产的有限责任；
2、企业性质不同：
（1）工作室是个体户性质的；
（2）公司是法人性质的；
3、组织形式不同：
（1）工作室一般属于个体户或个人独资企业，负无限责任；
（2）公司是以投资者投入的资金负有限责任；
4、税务登记上不同：
（1）工作室因为财务制度和核算不健全，一般是核定税额的，可以不记账；
（2）公司要求有健全的财务制度和核算制度，要求建立完善的账务，一般是按正常的营业额或销售额缴纳相应的税额。个人工作室拥有更好的税收优惠政策，可以节约费用，合理节税。
法律依据：《中华人民共和国公司法》第三条、公司是企业法人，有独立的法人财产，享有法人财产权。公司以其全部财产对公司的债务承担责任。
有限责任公司的股东以其认缴的出资额为限对公司承担责任；股份有限公司的股东以其认购的股份为限对公司承担责任。
