释义	法律分析：人民警察犯罪，且被判处剥夺政治权利或者有期徒刑以上刑罚的，才会因此被取消相应的警衔。如果是免于刑事处罚，则不会因此取消警衔。免于刑事处罚是在满足了上面所诉当事人的表现外，法庭认为当事人的过错有相当的危害性但尚不构成较大危害时所做出的裁定。法律依据：《中华人民共和国人民警察警衔条例》第二十二条人民警察被开除公职的，其警衔相应取消。人民警察犯罪，被依法判处剥夺政治权利或者有期徒刑以上刑罚的，其警衔相应取消。离休、退休的人民警察犯罪的，适用前款的规定。
