释义	法律分析：具体而言，一旦确定待决案例与指导性案例属于“同案”范畴，那么就应该对待决案件做出与指导性案例相同的法律处置。这里所言“相同的法律处置”主要是指对待决案件的法官要给予“类似案件”相同的法律认定并做出相应的或者肯定、或者否定的法律后果的裁判，而不是做出数量上相同法律后果的裁判。法律依据：《中华人民共和国刑法》第四条对任何人犯罪，在适用法律上一律平等。不允许任何人有超越法律的特权。
