释义	法律分析：退休不能签劳动合同。根据国家的规定，劳动者达到法定退休年龄后应退出劳动岗位。用人单位与劳动者签订的劳动合同期限不应超过劳动者的法定退休年龄。法律依据：《中华人民共和国劳动合同法》第四十四条劳动合同期满，有本法第四十二条规定情形之一的，劳动合同应当续延至相应的情形消失时终止。但是，本法第四十二条第二项规定丧失或者部分丧失劳动能力劳动者的劳动合同的终止，按照国家有关工伤保险的规定执行。
