释义	法律分析：房产抵押贷款银行一般是不会收房产证的，但是会收取他项权证，他项权是指除产权人及共有权人以外的其他团体或者个人对该房产涉及的权利，通常是指抵押权利。如果房子的他项权证未注销，该房产处置权会受到限制，未经银行同意将不能进行交易。法律依据：《中华人民共和国民法典》第三百九十七条以建筑物抵押的，该建筑物占用范围内的建设用地使用权一并抵押。以建设用地使用权抵押的，该土地上的建筑物一并抵押。抵押人未依据前款规定一并抵押的，未抵押的财产视为一并抵押。
