释义	法律分析：居住权和使用权不一样。居住权是一种用益物权，而使用权不属于物权。居住权指对别人所有的住房及其附属设施占有、使用的权利。设立居住权，可以根据遗嘱或者遗赠，也可以按照合同约定。设立居住权，应当向县级登记机构办理居住权登记，经登记后居住权才成立。居住权，不包括因房屋租赁产生的居住权，不包括住旅馆等，房屋租赁或者住旅馆不需要向房地产登记机构申请登记。法律依据：《中华人民共和国民法典》第三百六十九条居住权不得转让、继承。设立居住权的住宅不得出租，但是当事人另有约定的除外。
