释义	1、在检察院审查起诉阶段，认为犯罪事实不清、证据不足，需要补充侦查的，应补充侦查。对于补充侦查的案件，检察院仍然认为证据不足、不符合起诉条件的，可以作出不起诉的决定。2、在法院审判期间，如果证据不足，不能认定被告人有罪的，应当作出证据不足、指控的犯罪不能成立的无罪判决。法律依据：《中华人民共和国治安管理处罚法》第九十九条公安机关办理治安案件的期限，自受理之日起不得超过三十日；案情重大、复杂的，经上一级公安机关批准，可以延长三十日。为了查明案情进行鉴定的期间，不计入办理治安案件的期限。
