释义	1、不适用。第三人善意取得涉案财物的不予追缴，作为原所有人的被害人对该涉案财物主张权利的，人民法院应当告知其通过诉讼程序处理。2、受让人善意取得不动产或者动产的所有权的，原所有权人有权向无处分权人请求赔偿损失。但是关于刑事案件中涉案物品是否适用善意有很大的争议，有部分学者认为涉案物品不适用善意取得，应当一律追缴，返还给受害人。法律依据《民法典》第三百一十一条
