释义	两者的法律行为性质不同。遗赠是一种单方法律行为。遗赠人在立遗嘱时，不必征求受遗赠人的同意，即可在其遗嘱中作出遗赠的规定。此遗嘱在遗赠人死亡后即发生法律效力，并不受受遗赠人接受遗赠与否的影响。而生前赠与则是双方法律行为，是一种合同关系。法律依据：《中华人民共和国民法典》第六百五十七条赠与合同是赠与人将自己的财产无偿给予受赠人，受赠人表示接受赠与的合同。第一千一百二十三条继承开始后，按照法定继承办理；有遗嘱的，按照遗嘱继承或者遗赠办理；有遗赠扶养协议的，按照协议办理。
