释义	依法成立的合同自成立时生效，即使单方撕毁合同，合同依然有效。如果撕毁合同一方不履行合同约定的义务，另一方有权按照合同约定主张其违约责任，并且可以主张解除合同。【法律依据】《民法典》第五百七十七条，当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
