《中华人民共和国刑事诉讼法》第一百七十条 人民检察院对于监察机关移送起诉的案件，依照本法和监察法的有关规定进行审查。人民检察院经审查，认为需要补充核实的，应当退回监察机关补充调查，必要时可以自行补充侦查。 对于监察机关移送起诉的已采取留置措施的案件，人民检察院应当对犯罪嫌疑人先行拘留，留置措施自动解除。人民检察院应当在拘留后的十日以内作出是否逮捕、取保候审或者监视居住的决定。在特殊情况下，决定的时间可以延长一日至四日。人民检察院决定采取强制措施的期间不计入审查起诉期限。
