释义	法律分析：发包合同是指在将一份完整的工程分成几个部分分别交给承保单位的过程中，发包方与承包方根据双方自由协商并自由约定双方的权利义务的具体载体。发包合同只要没有我国法律规定的合同无效的条款，都是受法律保护的。法律依据：《中华人民共和国民法典》第四百六十三条本编调整因合同产生的民事关系。第四百六十四条合同是民事主体之间设立、变更、终止民事法律关系的协议。婚姻、收养、监护等有关身份关系的协议,适用有关该身份关系的法律规定有规定的,可以根据其性质参照适用本编规定。
