释义	违反规定使用明火作业或者在具有火灾、爆炸危险的场所吸烟、使用明火的，处警告或者五百元以下罚款；情节严重的，处五日以下拘留。过失引起火灾的，尚不构成犯罪的，处十日以上十五日以下拘留，可以并处五百元以下罚款；情节较轻的，处警告或者五百元以下罚款。任何人均有权要求吸烟者在禁止吸烟场所内停止吸烟；有权要求公共场所管理单位及其监督管理人员劝阻、制止吸烟行为；有权向卫生城管等行政主管部门举报违反本规定的行为。
