释义	检察院不批捕案子一般以补充侦查或退回公安机关侦查终结结束。若是因为证据不足需要补充侦查的，应当通知公安机关补充侦查；若是因为检察院认为犯罪嫌疑人的行为不构成犯罪而不批捕的，案子退回公安机关，由公安机关宣告侦查终结。法律依据：《中华人民共和国刑事诉讼法》第八十七条公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
