释义	法律分析：构成聚众淫乱罪的仅限于聚众淫乱的首要分子和多次参加者，所谓首要分子，是指召集、唆使、首倡聚众淫乱活动的人;所谓多次参加者，指首要分子以外的参加聚众淫乱活动至少达3次以上。其他情况不会构成。法律依据：《中华人民共和国刑法》第三百零一条聚众进行淫乱活动的，对首要分子或者多次参加的，处五年以下有期徒刑、拘役或者管制。引诱未成年人参加聚众淫乱活动的，依照前款的规定从重处罚。
