法律分析：入职一个月签合同合法，超过一个月没合同，第二个月起一年可以要求双倍工资，试用期提前三天通知单位辞职，过了试用期提前三十天书面通知单位辞职，没合同和提前多久辞职是两回事。
法律依据：《中华人民共和国劳动合同法》
第三十七条 劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期提前三日通知用人单位，可以解除劳动合同。
第八十二条 用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。
