民间借贷未约定利息的认定:当事人双方签订民间借贷合同时未约定利息，民间借贷案件起诉后，法院不会支持给付利息。但是，由于债务人逾期还款，债权人可以要求债务人给付逾期利息，即超过还款日期以后的，可以要求利息。
法律依据:《《中华人民共和国民法典》》第六百七十五条
【借款人返还借款的期限】借款人应当按照约定的期限返还借款。对借款期限没有约定或者约定不明确，依据本法第五百一十条的规定仍不能确定的，借款人可以随时返还；贷款人可以催告借款人在合理期限内返还。
