监狱企业的资本金是各级政府的财政拨款。企业的所有权是政府权属性质的而非全民性质的，这是由我国监狱生产的法定保障体制所决定的。这表明监狱生产的保障主体是国家，由于我国监狱履行中央和省两级管理，以省管为主的管理体制，所以这里讲的国家是指中央人民政府——国务院和省级地方人民政府。
法律依据：
《中华人民共和国监狱法》第八条国家保障监狱改造罪犯所需经费。监狱的人民警察经费、罪犯改造经费、罪犯生活费、狱政设施经费及其他专项经费，列入国家预算。
