释义	行为人实施的暴力行为给其家庭成员的身体、精神等方面造成一定的伤害后果，达到一定程度的，才可认定为家庭暴力。家庭暴力，是指家庭成员之间以殴打、捆绑、残害、限制人身自由以及经常性谩骂、恐吓等方式实施的身体、精神等侵害行为。《中华人民共和国民法典》第一千零四十二条禁止包办、买卖婚姻和其他干涉婚姻自由的行为。禁止借婚姻索取财物。禁止重婚。禁止有配偶者与他人同居。禁止家庭暴力。禁止家庭成员间的虐待和遗弃。该内容由王婧律师和点行律询共创回答
