释义	法律分析: 消费者和经营者应当遵循公平原则，确定各方的权利和义务。公平原则是指在市场经济中，对任何经营者都只能以市场交易规则为准则，享受公平合理的对待，既不享有任何特权，也不履行任何不公平的义务，权利与义务相一致。《中华人民共和国消费者权益保护法》第四条经营者与消费者进行交易，应当遵循自愿、平等、公平、诚实信用的原则。
