释义	法律分析: 交叉要约,是指当事人一方向对方为要约，而同时对方亦为同一内容的要约，且双方当事人彼此均不知有要约的现象。交叉要约能否成立合同，各国法律和学说的意见不一。我国《合同法》对此未作规定，但我们认为，从鼓励交易原则和效率价值的角度出发，应承认交叉要约可成立合同。法律依据: 《中华人民共和国民法典》第四百六十四条合同是民事主体之间设立、变更、终止民事法律关系的协议。婚姻、收养、监护等有关身份关系的协议，适用有关该身份关系的法律规定；没有规定的，可以根据其性质参照适用本编规定。
