释义	法律分析：嫖娼是否属于犯罪，不能一概而论。一般情况下，嫖娼属于违法行为，但是在以下的特殊情况下，嫖娼属于犯罪行为：1、嫖宿不满十四岁幼女的，以强奸罪论处。2、明知自己患有梅毒、淋病等严重性病嫖娼的，处五年以下有期徒刑、拘役或者管制，并处五千元以下罚金。法律依据：《治安管理处罚条例》第六十七条，“严厉禁止卖淫、嫖宿暗娼以及介绍或者容留卖淫、嫖宿暗娼，违者处十五日以下拘留、警告、责令具结悔过或者依照规定实行劳动教养，可以并处五千元以下罚款；构成犯罪的，依法追究刑事责任。”
