释义	法律分析：租赁所得税实际上是取得租赁收入的纳税人在开具租赁发票的同时，地税局按租金收入的一定比例预征个人所得税或者企业所得税。根据国家相关规定，这项所得税应由取得收入的一方缴纳。如果租赁合同上注明由承租方承担，不违法，合同也是有效的，因为税票上注明的纳税人依然是取得收入的那一方的名称。法律依据：《中华人民共和国税收征收管理法》第七十条纳税人、扣缴义务人逃避、拒绝或者以其他方式阻挠税务机关检查的，由税务机关责令改正，可以处一万元以下的罚款；情节严重的，处一万元以上五万元以下的罚款。
