释义	刑事案件申诉人可以委托律师代理向人民检察院提出申诉，并提供相应证据。经审查，具有下列情形之一，认为需要调查核实的，应当拟定调查提纲进行补充调查：原案事实不清、证据不足的；申诉人提供了新的事实、证据或者证据线索的；有其他问题需要调查核实的。【法律依据】《刑事诉讼法》第二百二十九条，被害人及其法定代理人不服地方各级人民法院第一审的判决的，自收到判决书后五日以内，有权请求人民检察院提出抗诉。人民检察院自收到被害人及其法定代理人的请求后五日以内，应当作出是否抗诉的决定并且答复请求人。
