专利期限到了怎么办

《专利法》只规定了专利权的期限，没有规定到期的续展问题，因此，专利权期限到了不能申请续展，该项专利进入公共领域。《专利法》规定，发明专利权的期限为二十年，实用新型专利权和外观设计专利权的期限为十年，均自申请日起计算。
