释义	法律分析：在公诉案件中，法院正式开庭后原告不能撤诉。自诉案件中开庭后可以撤诉。根据《民事诉讼法》规定，宣判前，原告申请撤诉的，是否准许，由人民法院裁定。人民法院裁定不准许撤诉的，原告经传票传唤，无正当理由拒不到庭的，可以缺席判决。法律依据：《中华人民共和国民事诉讼法》第一百二十四条人民法院对下列起诉，分别情形，予以处理：对判决、裁定、调解书已经发生法律效力的案件，当事人又起诉的，告知原告申请再审，但人民法院准许撤诉的裁定除外。
