释义	公平责任是指在当事人对造成的损害都无过错、不能适用无过错责任要求行为人承担赔偿责任，但如果不赔偿受害人遭受的损失又显失公平的情况下，由人民法院根据当事人的财产状况及其他实际情况，责令行为人对受害人的财产损失给予适当补偿的一种责任形式。法律依据: 《中华人民共和国民法典》第一千一百八十六条受害人和行为人对损害的发生都没有过错的，依照法律的规定由双方分担损失。
