释义	法律分析：法院在宣告失踪的判决中，为失踪人指定财产代管人。按照有利于管理失踪人的财产来确定财产代管人。财产代管人在涉及到失踪人的诉讼里面是直接作为原告或者被告的身份出现，而不是以失踪人的代理人的身份出现。法律依据：《中华人民共和国民法典》第四十三条财产代管人应当妥善管理失踪人的财产，维护其财产权益。失踪人所欠税款、债务和应付的其他费用，由财产代管人从失踪人的财产中支付。财产代管人因故意或者重大过失造成失踪人的财产损失的，应当承担赔偿责任。
