法院上下级之间的关系 |

上下级法院之间是监督与被监督的关系，不是领导关系。
根据《中华人民共和国宪法》第一百三十二条规定，最高人民法院是最高审判机关。最高人民法院监督地方各级人民法院和专门人民法院的审判工作，上级人民法院监督下级人民法院的审判工作。人民法院依照法律规定独立行使审判权，不受行政机关、社会团体和个人的干涉。
那么，上下级法院监督的方式是什么呢？
1、最高人民法院对地方各级人民法院和各专门人民法院已经发生法律效力的判决和裁定，上级人民法院对下级人民法院已经发生法律效力的判决和裁定，如果发现确有错误，有权提审，或者指令下级人民法院再审；
2、上级人民法院有权审判对下级人民法院的判决和裁定不服的上诉案件和人民检察院提起抗诉的案件；
3、上级人民法院有权审理按照审判监督程序提起的案件；
4、最高人民法院可以通过对具体应用法律的问题作出解释，纠正下级人民法院审判过程中的违法和不当行为。
