法律分析：1、 根据行为的表现形式不同
积极行为，又称“作为”，指以积极、主动作用于客体的形式表现的、具有法律意义的行为。
消极行为，又称“不作为”，指以消极的、抑制的形式表现的具有法律意义的行为。
2、 在法律上
这两种行为不能反向选择，即当法律要求行为人做出积极行为时他/她就不能做出消极行为，当法律要求行为人做出消极行为(禁止做出一定行为)时他/她也不能做出积极行为，否则就构成了违法行为。
