释义	法律分析：在一般情况下，见死不救只是道德谴责的对象，不属于刑法评价的范畴，不会构成过失杀人。见死不救，大体可以分为两种类型。一是有作为义务的见死不救，二是没有作为义务的见死不救。对于有作为义务的见死不救，那行为人是触犯刑法的。一般定性为故意杀人罪。对于没有作为义务的见死不救，不构成犯罪。法律依据：《刑法》第二百三十二条：故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
