释义	抢注商标的行为并不一定都是违法的。我国商标实行注册原则，保护在先注册的商标，只有抢注他人在先使用且具有一定影响力的商标，或者抢注他人有在先权利的商标，才构成恶意抢注，违反商标法。如果是抢注不具有一定影响力的商标，并不是违法行为。此外，若当事人是在不近似的商品上抢注有一定影响力的商标，同样也不是恶意抢注。由此可见，抢注商标不一定都是违法行为。《商标法》第三十二条　申请商标注册不得损害他人现有的在先权利，也不得以不正当手段抢先注册他人已经使用并有一定影响的商标。
