释义	法律分析：军婚，是与现役军人形成婚姻关系的婚姻。军婚，受到国家法律重点保护，破坏现役军人的家庭婚姻关系，应受到刑法的严厉打击。现役军人是指正在中国人民解放军或人民武装警察部队服役、具有军籍的人员。退役军人、复员军人、转业军人和军事单位中不具有军籍的职工，均为非现役军人，其婚姻关系均不能按军婚办理。法律依据：《中华人民共和国民法典》第一千零八十一条现役军人的配偶要求离婚，应当征得军人同意，但是军人一方有重大过错的除外。
