释义	根据法律规定，不能辨认自己行为的精神病人是无民事行为能力人，依法应当由其监护人履行监护职责。精神病人在不能辨认或者不能控制自己行为的时候违反治安管理的，不予处罚，但警方应及时采取约束性措施，避免造成他人的人身和财产损失，责令其监护人严加看管和治疗。法律依据：《精神卫生法》第九条 精神障碍患者的监护人应当履行监护职责，维护精神障碍患者的合法权益。禁止对精神障碍患者实施家庭暴力，禁止遗弃精神障碍患者。
