释义	一般经过国土局同意，且有房产证的国有划拨的房子就可以购买，但前提是卖方必须在交易前，补缴土地出让金，获取土地权证之后，才能正式上市交易，如果卖方不愿补缴土地出让金，那购房者只能选择终止交易，或者自己出钱补缴土地出让金。【本文关联的相关法律依据】《民法典》第三百四十七条设立建设用地使用权，可以采取出让或者划拨等方式。工业、商业、旅游、娱乐和商品住宅等经营性用地以及同一土地有两个以上意向用地者的，应当采取招标、拍卖等公开竞价的方式出让。严格限制以划拨方式设立建设用地使用权。
