释义	法律分析：我国目前立法与司法中尚未明确规定前科消灭制度。在我国法律实践中，曾受过刑事处罚的人，不管罪行轻重、主观恶性大小、是否彻底悔改，均存在犯罪记录，而且终身不能消除。法律依据：《中华人民共和国刑法》第一百条依法受过刑事处罚的人，在入伍、就业的时候，应该如实向有关单位报告自己曾受过的刑事处罚，不得隐瞒。《中华人民共和国刑事诉讼法》第二百七十五条规定：犯罪的时候不满十八周岁，被判处五年有期徒刑以下刑罚的，应当对相关犯罪记录予以封存。
