释义	通奸罪不够成犯罪。所谓通奸，是双方自愿发生性关系，不存在一方存在认识错误，或者是在一方违背其真实意思的情况下发生的性关系，所以不构成犯罪。即使是中国刑法目前没有通奸罪这个罪名，刑法没有规定为犯罪的，不属于犯罪(罪刑法定)，通奸属于违反道德的行为，一般不构成犯罪的。法律依据：《中华人民共和国刑法》第二百五十九条明知是现役军人的配偶而与之同居或结婚的，处3年以下有期徒刑或者拘役。第二百五十八条有配偶而重婚的或者明知他人有配偶而与之结婚的，处2年以下有期徒刑或者拘役。
