释义	法律分析：“一罪不二审”、“一案不二理” 法律依据：《公民权利和政治权利公约》第十四条任何人已经依照一个国家的法律和刑事程序被最后定罪或者宣告无罪的，就不得以同一罪名再予审判和惩罚。在一人按照最后决定已被判定犯刑事罪而其后根据新的或新发现的事实确实表明发生误审，他的定罪被推翻或被赦免的情况下，因这种定罪而受刑罚的人应依法得到赔偿，除非经证明当时不知道的事实的未被及时揭露完全是或部分是由于他自己的缘故。
