法律分析：如何理解过失致人死亡罪中的“情节较轻”，一是看被告人过失程度的严重性。对于过失致人死亡罪而言，虽然行为人对被害人死亡的发生在主观罪过上都表现为过失，但行为人过失的程度是可能存在差别的。既存在严重疏忽大意与一般疏忽大意之分，也存在轻信把握的大小和冒险程度之分。被告人主观上的过失之大小也反映了犯罪情节的轻重。如果被告人不顾他人劝阻，一意孤行，或者严重疏忽大意，很容易预见事故发生的可能性而没有预见，过失致人死亡的，则不能认定为情节较轻。二是看被告人先前相关行为的违法性。如果被告人在实施违法活动中过失致人死亡，则不应该认定为情节较轻。三是看被告人过失行为之目的。如果被告人行为之目的是为了受害人的利益，或为了公共利益之考虑，在行为中由于疏忽大意或过于自信而导致他人死亡的，可以认定为情节较轻。四是看其犯罪行为的后果和影响。犯罪行为的后果是评价犯罪行为严重性的最重要指标之一，过失致人死亡罪中，犯罪行为的后果和犯罪造成的影响不同，其犯罪的情节轻重也不同。一般来说，如果过失致使两人以上死亡的，不宜认定为情节较轻。如果过失致死的人身份特殊，造成影响较坏或损失较大，也不能认定情节较轻。对此可在司法实践中根据具体案件灵活把握。
法律依据：《中华人民共和国刑法》 第二百三十三条 过失致人死亡的，处三年以上七年以下有期徒刑；情节较轻的，处三年以下有期徒刑。本法另有规定的，依照规定。
