合作关系和劳动关系 -法律知识

法律分析:
一是关系的性质与对象不同，合作关系是利益共享关系，而劳动关系是在现实劳动过程中所发生的劳动者与提供生产资料的用人单位的关系是适应的法律与法律关系不同，合作关系适用法律是民法典并受其调整，劳动关系适用法律是劳动法及劳动合同法并受其调整。
法律依据:
《中华人民共和国劳动合同法》第七条 用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
