法律依据：
《国务院关于职工工作时间的规定》
第一条为了合理安排职工的工作和休息时间，维护职工的休息权利，调动职工的积极性，促进社会主义现代化建设事业的发展，根据宪法有关规定，制定本规定。
第二条本规定适用于在中华人民共和国境内的国家机关、社会团体、企业事业单位以及其他组织的职工。
第三条国家实行职工每日工作8小时、平均每周工作40小时的工时制度。
