释义	法律分析：根据我国的相关法律法规的规定可知，不当得利本身属于民法上的一种法律事实，不构成犯罪，不当得利人将获得的利益予以返还即可，但是如果不当得利人拒不返还，数额较大，情节严重的，可能就会触犯其他法律上的侵占罪，此时就要追究刑事责任了。法律依据：《中华人民共和国民法典》第九百八十五条得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：（一）为履行道德义务进行的给付；（二）债务到期之前的清偿；（三）明知无给付义务而进行的债务清偿。
