释义	法律分析: 被继承人活着遗嘱不可以生效。因为我国法律明确规定，继承从被继承人死亡时开始。相互有继承关系的数人在同一事件中死亡，难以确定死亡时间的，推定没有其他继承人的人先死亡。前述死亡时间包括宣告死亡和生理死亡时间。法律依据:《《中华人民共和国民法典》》第四十六条自然人有下列情形之一的，利害关系人可以向人民法院申请宣告该自然人死亡: （一）下落不明满四年；（二）因意外事件，下落不明满二年。
