释义	法律分析：合同解除与合同无效是两种性质完全不同的制度。合同无效是合同不符合法律规定的合同有效的条件，合同关系不应当成立；合同解除是消灭已生效的合同。另外，无效合同是当然无效，即使当事人不对合同效力提出主张，人民法院或者仲裁机关也有权确认合同无效；合同解除主要适用合同自由原则，即使符合法律规定的解除条件，当事人不行使解除权，国家也不必干涉。法律依据：《中华人民共和国民法典》第五百五十七条第二款规定，合同解除的，该合同的权利义务关系终止。
