释义	法律分析：起诉状副本送达被告后，原告提出新的诉讼请求的，人民法院不予准许，但有一种情形例外，公民、法人或者其他组织起诉请求确认行政行为无效，人民法院审查认为行政行为不属于无效情形，经释明，原告请求变更诉讼请求为撤销行政行为的，应当继续审理并依法作出相应判决；原告请求撤销行政行为但超过法定起诉期限的，裁定驳回起诉；原告拒绝变更诉讼请求的，判决驳回其诉讼请求。法律依据：《中华人民共和国民事诉讼法》第五十一条原告可以放弃或者变更诉讼请求。被告可以承认或者反驳诉讼请求，有权提起反诉。
