企业未给员工缴纳社保怎么办

用人单位未给员工缴纳社保的，属于违反法律规定的情形。员工可以选择先与单位进行协商，协商一致的，由用人单位为职工购买社保。若是双方存在无法协商或者协商不成的情形，员工可以向仲裁委申请仲裁，对仲裁不服的，还可以向法院起诉。

《中华人民共和国社会保险法》第五十八条用人单位应当自用工之日起三十日内为其职工向社会保险经办机构申请办理社会保险登记。未办理社会保险登记的，由社会保险经办机构核定其应当缴纳的社会保险费。
