释义	法律分析: 如果案件移送人民检察院审查起诉后，在监视居住期限届满或者发现不应当追究犯罪嫌疑人刑事责任的，人民检察院应当撤销监视居住，并通知执行机关，以及将撤销监视居住的决定书送达犯罪嫌疑人。法律依据:《《人民检察院刑事诉讼规则》》第一百一十五条监视居住期限届满或者发现不应当追究犯罪嫌疑人刑事责任的，应当解除或者撤销监视居住。解除或者撤销监视居住的决定应当通知执行机关，并将解除或者撤销监视居住的决定书送达犯罪嫌疑人。
