与现役军人的配偶通奸，从立法本意上讲则不能认定为犯罪。所谓结婚，是指与现役军人的配偶采取欺骗手段骗取结婚登记或者虽未登记但长期以夫妻名义共同生活而形成事实婚姻的行为。
【法律依据】：
《中华人民共和国刑法》第二百五十九条 破坏军婚罪，是指明知是现役军人的配偶而与之同居或者结婚的行为。明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。利用职权、从属关系，以胁迫手段奸淫现役军人的妻子的，依照本法第二百三十六条(强奸罪)的规定定罪处罚。
