释义	律师分析: 要约，是当事人一方向对方发出的希望与对方订立合同的意思表示。发出要约的一方称要约人，接受要约的一方称受要约人。要约是订立合同的必经阶段，不经过要约的阶段，合同是不可能成立的，要约作为一种订约的意思表示，它能够对要约人和受要约人产生一种拘束力。尤其是要约人在要约的有效期限内，必须受要约的内容拘束。【法律依据】: 《中华人民共和国民法典》第三十三条要约是希望和他人订立合同的意思表示，要约中必须表明要约经受要约人承诺，要约人即受该意思表示拘束。
